Forgery in the Samaja: Trade Union’s FIR registered Against SoPS Members and IAS (Rtd) Suresh Chandra Mantry

The forgery committed on Gopabandhu’s Will having been exposed, President of Utkalmani Newspaper Employees Association Sri Deviprasanna Nayak had put the information before the IIC of Cantonment Police Station, Cuttack on May 12, 2015 demanding criminal action against the members of the Servants of the People Society as well as a retired IAS officer Suresh Chandra Mantry and a former Editor of the paper Sri Gopalkrushna Mohapatra, for use of the forged Will despite knowing that the same is forged. After inordinate delay of around three weeks, the IIC has registered the FIR on May 31, 2015, under sections 420/465/467/468/471/34 IPC, which are the major penal provisions against the crime of forgery. The punishments under these sections are very stiff.

Section 420 stipulates that “whoever cheats and thereby dishonestly induces the person deceived any property to any person, or to make, alter or destroy the whole or any part of a valuable security, or anything which is signed or sealed, and which is capable of being converted into a valuable security, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.

Section 465 mandates, “Whoever commits forgery shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.

Section 468 provides for life imprisonment or imprisonment of either description for a term which may extend to ten years and fine. Under this section whosoever is not give life imprisonment, shall be punished with imprisonment up to ten years with fine. Its language is: “Whoever forges a document which purports to be a valuable security or a will, or an authority to adopt a son, or which purports to give authority to any person to make or transfer any valuable security, or to receive the principal, interest or dividends thereon, or to receive or deliver any money, moveable property, or valuable security, or any document purporting to be an acquittance or receipt acknowledging the payment of money, or an acquittance or receipt for the delivery of any moveable property or valuable security, shall be punished with *[imprisonment for life], or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine”. * Subs. by Act 26 of 1955, s. 117 and Sch., for “transportation for life” (w.e.f. 1-1-1956).

Section 468 provides that “Whoever commits forgery, intending that the *[document or Electronic Record forged] shall be used for the purpose of cheating, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine”. * Subs. by Act 21 of 2000, sec. 91 and Sch. I, for “document forged” (w.e.f. 17-10-2000)

But Section 471 is for users of forged Will. The fellow who uses a forged Will shall be punished with imprisonment and fine. It says, “Whoever fraudulently or dishonestly uses as genuine any *[document or electronic record] which he knows or has reason to believe to be a forged **[document or electronic record], shall be punished in the same manner as if he had forged such **[document or electronic record]. * Subs. by Act 21 of 2000, sec. 91 and Sch. And, Section 34 provides punishment to gang of criminals. It says, *”When a criminal act is done by several persons in furtherance of the common intention of all, each of such persons is liable for that act in the same manner as if it were done by him alone”. *Subs. by Act 27 of 1870, sec. 1, for the original section.

So, the criminals in the forte of the Samaja and SoPS are now to face the law that calls for imprisonment and fine.

The two fellows who had forged the Will of Gopabandhu – former ministers of Orissa and editors of the paper, Radhanath Rath and Lingaraj Mishra –  have died before their crime was detected. Another criminal Manu Bhai Patel has died recently. Another accused – Santosh Kumar Muduli is also dead. Udaynath Sadangi whose name is in the written information is also dead. The trade union shall demand for posthumous punishment to them as they were individually and collectively perpetrators and users of the forgery.

Some other fellows who have been named in the FIR, but not shown as accused, will hopefully come to books by the time the charge sheet would be ready.

The accused enlisted by the investigating officer, pending final updatation of the list, are: (1) Manubhai Patel, (2) Raj Kumar, (3) Deepak Malviya, (4) Vimsen Yadav, (5) Prasanna Vadan Mehta, (6) Onkar Chand, (7) Niranjan Rath, (8) Kirtibhai Pandya, (9) Ajay Kumar, (10) Gopalkrushna Mohapatra, (11)Suresh Chandra mantry, (12) Santosh Kumar Muduli and (13) Lingaraj Mishra. The first and the two last accused persons are, as mentioned supra, dead.

(Note: The 12th accused is not an accused in reality. He is one of the victims of the offenders. The IIC has inadvertently mentioned his name and prefixed it with a nonextistence mark, in place of, according to him, late Radhanath Rath.)

The living culprits have a gang of hounds from the pull of retired IAS officers, IPS officers, and Judges in their service as advisors, who are lobbying for killing of this FIR. They have also a powerful ally in Chief Minister’s Office, who, despite being a junior officer is being regarded as ‘Super Chief Minister’ from whom Cabinet Ministers and Secretaries including the Chief Secretary are getting instructions as if from the Chief Minister. His protection to Samaja hijackers is a great obstacle in action against located culprits that stay safe in the ramparts of the Gopabandhu Bhawan. The inordinate delay in registration of the well documented FIR is because of their pressure.

So, despite lobby by the pack of hounds – former IAS, IPS, IFS Officers and Judges – the case cannot die sans action.

With this case, a new chapter in the history of mass action against crime by fellows, who have been dazzling under the arch of journalism misusing the media power of the Samaja, is going to be written in golden letters.

Orissa High Court heavily censures SoPS for acts of personal aggrandizement

Selfless Journalists under the banner of “Save the Samaja Forum” and employees of ‘The Samaja’ on the platform of their trade union “Utkalmani Newspaper Employees Association” have been continuously alleging that a pack of self-seeking criminals, who use Lala Lajpat Rai’s Servants of the People Society as their identity, have seized the Oriya daily “The Samaja” by forging a Will of its founder Utkalmani Gopabandhu Das and looting its funds and misusing its media power for their personal aggrandizement, while keeping the State Government run by Naveen Patnaik as well as media organizations run mostly by economic offenders in Orissa muzzled, as evidenced in their total silence when it is known to them that the newspaper based on contribution of the people of the State is being looted and the morality Gopabandhu stood for is being butchered.

Orissa High Court in a judgment passed on January 22, has severely censured the said society’s office bearers – erstwhile and existing – for their acts of “personal aggrandizement”.

“Before parting with the case”, a division bench comprising Chief Justice Mr. A. K. Goel and Justice A. K. Rath, while rejecting the writ appeal of Niranjan Rath and others that have occupied ‘The Samaja’ and SoPS office, has said, “we would like to observe that the SoPS was founded by a great freedom fighter and prominent leader of the country, namely, Lala Lajpat Rai in the year 1921. The society is devoted to enlist and train national missionaries for the service of the motherland. it publishes a premium Oriya Daily “The samaja”. But of late the office bearers of SoPS, both erstwhile and existing, have dragged the institution/”The Samaja” to portals of the court to satisfy their personal aggrandizement. The founding members of “The Samaja” in their wisdom had never thought that a day will come, when the office bearers will approach the Court for settlement of their disputes. Let good sense prevail amongst members of the executive council/office bearers to devote time for the society instead of settling their scores in the court”. (Para 18, Judgment in W. A.No 532 of 2013).

Niranjan and his team, like habitual litigants, had wanted quashing of order of a single Judge of the High Court that had approved the decision of the District Judge of Cuttack, who, in an order, had denied them free hand to use the Samaja funds.

The District Judge had held that, even though he was not to pass any finding in the matter of the suit pending in the trial Court relating to election of office bearers SoPS challenged by its life member Sri K. C. Tripathy, to him, Sri Tripathy had “a full proof case”.

Therefore, instead of quashing the election and leaving the issue to the trial Court, the District Judge had ordered that till finalization of the suit, the group that has occupied SoPS/The Samaja, “shall not take any policy decision having financial implications except meeting the day to day expenses” on publication of the paper including wages of the employees.

Niranjan and his team had come to the High Court for nullification of the restriction imposed on expenditure and had failed, as the Single Judge found the DJ order perfectly flawless. Now the writ appeal against the single Judge’s verdict has failed in the Division Bench headed by the Chief Justice.

The appeal of the occupiers of the Samaja has not only failed, but also the litigants have earned the stricture.

The Court has tightened the leash put on Niranjan and his team by mandating that they “shall not take any policy decision/final decision without leave of the trial Court”.

And, they are judicially advised not to indulge in “personal aggrandizement” at the cost of ‘The Samaja’.

Kar Seva in Bakula Bana the first step towards revival of Bana Bidyalaya

Save the Samaja Forum and leadership of the employees of the daily newspaper Samaja – Utkalmani Newspaper Employees Association – collectively rendered Kar Seva and removed the ugly garbages that had engulfed the seats of the statues of Utkalmani Gopabandhu Das and his famous colleagues lying abandoned in the campus of the now extinct, Jatiya Bana Bidyalaya (National School on the lap of Nature) that they had established. Eminent senior citizens and apolitical young men of Satyavadi/Sakshi Gopal area gladly participated.

After the Kar Seva, in a meeting on the spot under chairmanship of UNEA President Deviprasanna Nayak, the Pancha Sakha – Pt. Gopabandhu, Pt. Nilakantha Das, Pt. Godavarish Mishra, Acharya Harihar Das, and Pt. Krupasindhu Mishra – were fondly recalled. A former student of the Bana Vidyalaya, retired from Crime Branch of Orissa Police, Shankarshan Mishra reminisced about the excellent environment of education Gopabandhu had conceived of and executed.

Convener of SSF and Chief of ORISSA MATTERS Subhas Chandra Pattanayak made specific mention of how the Bana Vidyalaya was a “man-making institute” and how modern education moulded in the matrix of ancient Gurukula system of didacticism was building up students to work for independence and consequential prosperity of the country. He stressed on revival of the Bana Vidyalaya in the Bakula Bana and demanded that the State Government must take steps to recover the millions and millions of rupees from the Servants of the People Society that has swindled the funds generated by the Samaja in order to recreate the Bana Vidyalaya with the same, as Gopabandhu had desired. It was treated as a resolution and unanimously approved.

Local youth lights like Rajesh Kumar Mohapatra and Satyabrata Hota pledged their support to the proposed campaign for recovery of the Samaja funds from SoPS and revival of the Bana Vidyalaya with that fund.

President Deviprasanna Nayak, eminent journalist who heads the Utkalmani Newspaper Employees Association, declared that UNEA will render total support to SSF in reviving the Bana Vidyalaya in the Bakula Bana and asked the authorities not to vitiate it with any non-academic activities. The Bakula Bana must have to be preserved as the revered citadel of the five most patriotic and visionary teachers, he said.

SSF co-ordinator and media consultant Pabitra Maharatha thanked everybody for the co-operation in Kara Seva and adoption of the resolution to recover the Samaja money from SoPS and revival of the Bana Vidyalaya in its original campus – the Bakula Bana.

Prominent amongst the participants were former students of the Bana Bidyalaya Shankarshana Mishra, Prakas Chandra Mishra, Sarat Kumar Mekap, and UNEA General Secretary Subash Chandra Singh.

This is how the revered statue of Pandit Gopabandhu Das, famous as Utkalmani, the Crown Jewel of Orissa, whose humanitarian services to the downtrodden people has no comparison, was lying abandoned in a very sickening ugly condition in the campus of the extinct Jatiya Vana Vidyalaya (The National School of India on the lap of Nature) when in company of media consultant Pabitra Maharatha I had an occasion to visit the place.

Servants of the People Society, which misappropriates millions and millions of rupees earned by Gopabandhu’s newspaper – The Samaja – by manufacturing a false Will of the late leader, has never bothered to maintain the site.

There are many persons who boast of their blood link with Gopabandhu. None of them has ever wanted to keep his statue in a decent condition.

We in ‘Save the Samaja Forum’ (SSF) decided to discourage the disrespect shown to Gopabandhu and his friends whose statues in the Vakula Bana were also suffering similarly sickening negligence. The Trade Union of the employees of ‘The Samaja’ – the Utkalmani Newspaper Employees Association (UNEA) – readily came forward to co-operate.

Gopabandhu and his friends were all eminent freedom fighters and with the principal purpose to create educated patriots to make the dreams for a prosperous sovereign republic come true, they had established the Bana Bidyalaya. We therefore decided to to offer our Kar Seva at the asthans of the Panchasakha on the Republic Day, 2014.

On January 25 we initiated the action by informing the people of Satyavadi about our idea of salvaging the Pancha Sakha statues from the heap of gut-wrenching negligence and disrespect. We found the Bana Vidyalaya site locked, with its key in custody of an temple executive. We met him and requested him to keep the Bakula Bana open on January 26 for our Kar Seva, giving him a printed copy of our appeal to the people against disrespect being shown to the Pancha Sakha statues. As we reached the entrance gate on January 26, we found the gate locked with garbages and litter covering the entry path. We swept them out, while waiting for the endowment caretaker to unlock the gate.

The mission was christened “Bakula Bana Safei Abhijan”. Eminent citizens of Satyavadi were one with SSF and UNEA in cleaning the garbages.

Then the statues as well as the podiums of Gopabandhu and the other four revered teachers were cleaned.

What is happening in ‘The Samaja’ when illegal occupiers have seized it fraudulently?

The Servants of the People Society (SoPS) has not yet been able to prove that it has not seized Orissa’s premier newspaper ‘The Samaja’ by forging a WILL of its founder Pandit Gopabandhu Das.

But on complaint from ‘Save the Samaja Forum’ (SSF), when the Registrar of Newspapers for India (RNI) asked the Additional District Magistrate (ADM) of Cuttack to enquire into and report on legitimacy of the claim of ownership by SoPS, the Chief Minister of Orissa was used by the illegal occupiers to create a climate for the ADM to abandon his enquiry midway and to submit a spurious report with no specific answer to the query.

SSF has written to RNI to discard the ADM’s report as spurious and to institute a fresh enquiry at his end, as the Law does not permit any newspaper to run under fake ownership; and, as any enquiry by any officer or agency of Orissa Government would not be reliable because of the illegal occupiers’ direct nexus with the Chief Minister.

A reliable document reveals that there was a deal of clandestine money amounting half a crore of rupees between Chief Minister Naveen Patnaik and the then SoPS chief Manubhai Patel and the same illicit relationship between the both continues till date, as otherwise a huge land reserved for a very important public purpose by the State Government could never have been given to a protege of Patel for a Hotel at Bhubaneswar in the neighborhood of the State Forensic Laboratory at throwaway price and the State Government could not have sat idly so far over constitutional objection to this illegality by the Comptroller and Auditor General of India.

When the SOPS is in such nasty nexus with the Chief Minister of Orissa, the occupiers of the Samaja have been enjoying immunity against inhumane exploitation of workers. The workers have been kept under such intimidation that seldom they object to their exploitation. When someone prays for fair pay he gets thwarted out of his job.

Gagan ParidaLet me give you a single instance. Gagan Parida is an employee of the Samaja for last 30 years. He works through out the night to make bundles of the paper for despatch to various destinations. This is a very essential job in the establishment and consumes his time from 5 in the evening to 5 in the morning. Though he has worked for 30 years and has become old, he has not been regularized and not been put to a time scale. Thus he is debarred from Dearness Allowance, Provident Fund benefits, Health Care benefits, House rent allowance during his employment period and would be debarred from all the welfare provisions including Gratuity and Pension after his employment, which the Labor Laws and specifically the Law for newspaper employees offer.

Parida is not alone in this category of employees of the Samaja. At least 14 of his type have moved the Labor Laws Implementation Authority to intervene. Their allegation is: They all have been debarred from entering into their workplace, as they prayed the management for regularization in service with retrospective effect and for regular pay as newspaper employees are entitled to. Thus they have been de facto dismissed.

But the political clout the illegal occupiers of the Samaja have, has stood a obstacle to admission of their allegation into conciliation even.

Gopabandhu was a paragon of all humane virtues. He was a personification of pity and concern for human beings. To save people from exploitation, he had been leading mass awareness campaigns and The Samaja newspaper was established by him as a part of this campaign. In his paper, the illegal occupiers have been perpetrating such inhuman exploitation.


Samaja in the maze of forgery: RNI moved to reject ADM’s spurious report and conduct enquiry in right earnest, as Law does not allow any newspaper to run under fake ownership

Servants of the People Society, New Delhi, has illegally captured the Oriya daily ‘Samaja’ by taking advantage of a WILL of one of its founders Pt. Gopabandhu Das forged by his protege Lingaraj Mishra in nexus with Radhanath Rath, both of who had benefited from being successive editors of the paper and, induced to Orissa cabinet by virtue of their association with the powerful daily, had gained immensely in political life. They, in fact, had transformed the paper from basically a social service utility to a power-politics game field, where only the religious revivalists and right-reactionaries were / are conspicuous by their presence.

This transformation has played a major role in strengthening right-reactionary political set-ups in Orissa. Naturally, therefore, the present chief minister, who is known more for being a server of the interest of mega industrial houses like POSCO/Vedanta/Tata/Jindal etc than of the interest of indigenous Oriyas, has found in it an obliging ally. This nexus is demoralizing the officers so much that a district labor officer – P.K.Mohapatra – did not dare to wake up against unfair labor practices rampant in the Samaja establishment despite being notified for several months, and, instead of punishment for this stark violation of his duties as the area labor officer, he was rewarded with a promotion, to the detriment of morality of fellow officers.

Sadly, the syndrome has expanded to other departments too. It is horrific to see that government officers are being forced to serve the interest of the illegal occupiers of this paper by the circumstances created by the Chief Minister himself. A glaring instance has come to light when the ADM of Cuttack, asked by the Registrar of Newspapers for India (RNI) to enquire into alleged illegitimacy of declared owners of the Samaja, had to stop enquiring midway to feed the RNI with a spurious report, after Save the Samaja Forum (SSF) filed a Writ Case in the Orissa High Court seeking a directive to the said ADM to act diligently on the RNI’s direction. The shenanigans marked in the ADM’s office convince us that the ADM was under pressure to rush his spurious report to RNI in order only to render the Writ petition inconsequential.

And, curiously, the ADM had to abandon his enquiry midway under pressure. From documents obtained under RTI, it transpires that, the ADM had asked the Government Pleader of Cuttack to give his legal opinion in the matter; but before the GP could prepare his legal opinion, the ADM closed his enquiry in utmost hurry and without even asking the raisers of the allegation to substantiate their allegation, rushed his report to the RNI. He was, as our sources say, under alarming pressure from above to close the enquiry and send his report to RNI as quickly as possible. Therefore, he had to abandon the enquiry midway.

It is noteworthy that only a day after the ADM was notified by the Advocate General of the Writ Case filed by SSF, he had to entertain a fake WILL of Gopabandhu submitted to him by illegal occupiers of the Samaja and without any enquiry into whether or not it was a genuine copy of the WILL, when absence of any semblance of genuine certification of the true copy, if it was so, of the WILL was crying for such an enquiry, the ADM rushed his spurious report to RNI, within 4 days of being notified of the Writ Case. The ADM was so much overwhelmed by the pressure from above that he did not informed the SSF of closure of the enquiry and submission of his report on July 5, 2013 even when he received a memo from SSF on July 16, 2013, demanding expeditious enquiry.

The SSF has raised a complaint against the spurious report of the ADM and demanded for a fresh enquiry by the RNI as the Press Laws do not allow a newspaper to run under fake ownership.

We the undersigned are reporters of at least forty years standing. On behalf of “Save the Samaja Forum”, we had urged upon you to please intervene and halt the illegal publication of the Oriya daily “Samaja” (Cuttack) under false ownership of Servants of the People Society, Lajpat Nagar, New Delhi.
The Society above named has been using a false and fabricated WILL of original owner of the paper, late Pt. Gopabandhu Das claimed to have been dictated on his deathbed, just before he breathed his last on 17.6.1928. Like all others of Orissa, we too were mislead to believe the above claim to be factual, because the people who forged the WILL were known for their close proximity to Gopabandhu and had gained public esteem by successively occupying the editorship of the paper. It was beyond our perception that such persons of politico-social eminence could have resorted to naked forgery to occupy the popular paper of the late leader.
But as no sin can be hidden for all time to come, Subhas Chandra Pattanayak, Representative-in-Chief of Orissa’s premiere website stumbled upon the “exact photo copy of Gopabandhu’s last will” while browsing old papers of the 1980s in professional pursuit. That “exact photo copy of the Will” did not carry the signature of Pt. Gopabandhu Das. Shocked by the unexpected discovery, he conducted a thorough research and found various documents that made him suspect that the Samaja is licensed to run under fake ownership. The forgers had operated under the umbrella of the Servants of the People Society and from their time, the said society has kept the forgery a secret and has fetched tremendous financial benefits by continuously cheating the RNI over ownership of the paper
in sharp contravention of and blatant disregard to the governing law. He exposed the matter in That constituted the base of Save the Samaja Forum, which wanted the Servants of the People Society and/or the Samaja to remove the suspicion the stumbled upon “exact photo copy of the WILL” was creating. But they kept mum. They had inserted a quarter-page advertisement in page 1 of the daily Samaja in appealing the public to ignore the allegation raised by Save the Samaja Forum; but they never came out with the genuine WILL, if any, to clear the doubt over ownership. This led the undersigned to attract your kind attention to the dubious ownership of the paper.
We are thankful to you for having initiated immediate action on our complaint. You were pleased to request the A.D.M. of Cuttack to conduct an investigation into the matter and report on action taken (Annexure-1).
But the A.D.M. has sent you his report without any inquiry (Annexure-2).
We had met the A.D.M. many times personally to request him to conduct the inquiry as expeditiously as possible. But regretfully the A.D.M. has sent you the report under Annexure-2 without any inquiry and without even asking us to substantiate our allegation.
It is a matter of great concern that the A.D.M. has, behind our back, entertained a fake WILL of Gopabandhu submitted by the illegal occupiers of the Samaja, even though that copy of the so called WILL is not a valid certified copy of the said WILL.
We have obtained on 13.08.2013 the photocopies of the WILL submitted by the wrongful occupiers of the Samaja through their General Manager by using RTI. A copy thereof is enclosed (Annexure -3) for your kind perusal. It is not a certified copy, whereas we have documents in our possession that proves that, this WILL submitted by the illegal occupiers of the Samaja to the A.D.M. is a fake WILL. Had the A.D.M. asked us to substantiate our allegation we could have submitted the relevant documents.
It is necessary to say here that, the A.D.M., Cuttack had asked the Tahasildar of Cuttack Sadar by his letter No. 62/Gen. & Misc. dated 04.01.2013 to inquire into our allegation and report within a week. The Tahasildar gave his response to A.D.M. in his letter No. 4584 dated 21.06.2013. The A.D.M. then wrote a letter to the government pleader, Cuttack on 25.06.2013 vide No. 2985 requesting him to examine the documents and submit his legal opinion (Annexure-4).
As it was clear to us that the A.D.M. was not acting in right earnest on your letter referred to above we preferred a Writ Petition in the Hon’ble High Court of Orissa seeking a direction to the A.D.M. for compliance of your orders. The Writ Case filed on July 01, 2013 bears the No. W.P. (C) 14507 of 2013. As per judicial custom in vogue, the copy thereof was given to the Advocate General of Orissa instantly who also immediately informed the A.D.M. of the case.
In order to render the Writ Case inconsequential, without waiting for the legal opinion of the government pleader that he had sought for (Annexure-4), the A.D.M. has sent you the misleading and wrongful report on 5th of July, 2013 vide his letter referred to above (Annexure-2).
The crux of the issue is fake ownership of the Samaja based on a forged WILL of Pt. Gopabandhu Das. In order to continue to print and publish the Samaja, the Servants of the People Society is to prove that the WILL of Pt. Gopabandhu Das which constitute the base of its ownership over the paper, is genuine. If they fail to prove the genuineness of the WILL they have produced, they must be debarred from publishing the daily Samaja under their ownership. The law does not allow continuance of publication of a newspaper under false and fake ownership.
Therefore, and specifically as the A.D.M. has blatantly failed in his duty to conduct necessary inquiry and has accepted a fake WILL as genuine to mislead you, we request you to please reject the wrong report of the A.D.M. and to please stop publication of the Oriya daily ‘The Samaja’ under false ownership till at least the Servants of the People Society proves that the WILL they have produced before the ADM of Cuttack is genuine and on the basis of the same, their ownership over the Samaja is also genuine.

Illegal occupiers of the Samaja dismantle the statue of Gopabandhu to please the Chief Minister

statue of gopabandhu in gopabandhu bhawan dismantledReport reaches us that the gang of miscreants who have illegally occupied the Samaja founded by Utkalmani Gopabandhu Das have dismantled his statue in the Gopabandhu Bhawan, Cuttack where the newspaper has its headquarters.

This nasty act is performed to please Chief Minister Naveen Patnaik who is eager for publicity with the general elections knocking at the door.

Patnaik is invited to unveil a new statute of Gopabandhu in place of the dismantled statue.

The dismantled statue was unveiled by Dr. Radhanath Rath, then the editor of the Samaja. The present gang of occupiers of the Samaja is headed by a non-Oriya Manubhai Patel through a challenged illegal election of office bearers of the Servants of the People Society (SoPS). Patel had taken huge money from the Samaja fund for his electioneering in Gujurat with the assurance to return the same within a short span of time. As he did not refund the same, despite repeated reminders, Dr. Rath had raised an allegation against him before the SoPS top brass. Dr. Rath had also exposed him as a man of moral turpitude. Therefore, having occupied the Samaja, even when his incumbency is challenged in the Court, he is determined to wipe out Dr. Rath’s name inscribed in the stone plate on the base of the statue of Gopabandhu.

And, to do this, the gang of illegal occupiers of the Samaja have somewhat arranged the Chief Minister’s consent.

But, in inviting the CM to unveil the replacement, the Manubhai gang has another motive too.

And, that is to browbeat the ADM of Cuttack who is conducting an inquiry into illegal occupation of the Samaja by SoPS.

This society, known then in Orissa as a platform of Gopabandhu for social service, and manned, then, by Gopabandhu’s proteges like Lingaraj Mishra and Radhanath Rath, has kept the paper in its wrongful capture by forging a will of Gopabandhu in its favor. After ORISSAMATTERS.COM exposed the forgery, some eminent media persons have formed a body namely “Save the Samaja Forum” to save the people’s paper of Orissa from the wrongful occupiers and have moved the Registrar of Newspapers for India to ensure that the paper founded by Utkalmani Gopabandhu Das and funded by the people of Utkal is no more left under a fraudulent ownership. The RNI has asked the ADM, Cuttack to enquire into the ownership issue and report.

The ADM had asked Cuttack Sadar Tahsildar to find out if the SoPS has any real will of Gopabandhu to claim ownership of the Samaja as it has been doing. The Tahsildar enquired into the matter to the best of his ability and to him, the occupiers of the Samaja could not show any proof in support of their ownership. But, before he could reduce his findings to a report, he was forced to abandon the inquiry and to simply return the matter to the ADM. This was under tremendous political pressure allegedly from a close cabinet colleague of the Chief Minister, Debi Pr. Mishra, who not only hails from the sub-division to which printer of the paper Niranjan Rath belongs, but also is tom-tomed as his relation.

The ADM, on enforced abandonment of the enquiry by the Tahsildar, and return of the file to him, is in a predicament. He cannot simply refuse the RNI to conduct an enquiry; because the ADM is officially the RNI’s agent in the district. If he conducts the enquiry, it would certainly come to his knowledge that SoPS is not the legal owner of the Samaja whereas it has filed blatantly wrong declaration on ownership of the paper.

As such, when authenticity of SoPS as owner of the Samaja is very much in dispute, by accepting their invitation to unveil a new statue of Gopabandhu in the Samaja premises, the Chief Minister will be giving them credibility as owners of the Samaja. And, thereby, helping them to browbeat the ADM.

Whether or not the CM has the intelligence to understand this foul play of the illegal occupiers of the Samaja is a matter to be watched.
